A proposed adjudication in this matter was drafted by Dennis J. Harnish, Esq., formerly Chairman of the Environmental Hearing Board who has been appointed as a hearing examiner in the above-captioned matter. In preparing the proposed adjudication Mr. Harnish reviewed the notes of testimony taken during a hearing held on March 9, 1981 as well as the exhibits introduced during that hearing and the post-hearing briefs filed by appellant and DER. This proposed adjudication has been reviewed and adopted by the board.
