OPINION
FORESTER, Chief District Judge.
Christopher Robinson appeals his conviction on two counts of bank robbery and two counts of carrying a gun in connection with the robberies. He raises five assignments of error. First, Robinson argues that the district court erred when it dismissed his first indictment without prejudice, pursuant to the Speedy Trial Act, 18 U.S.C. § 3161, et seq.
