We have before us an appeal filed by the Commonwealth of Pennsylvania, Department of Transportation (appellant), from an Opinion and Order of the Court of Common Pleas of Franklin County. On the afternoon of June 28, 1970, Oscar Paul Bechtel, appellee (Bechtel), while operating his automobile in the City of Chambersburg, was involved in an accident.
