Petitioners/plaintiffs (for ease of reference, hereinafter petitioners) have brought this combined CPLR article 78 proceeding and declaratory judgment action to challenge the issuance of a temporary revocable permit (TRP) allowing defendant/respondent NYCO Minerals, Inc. (NYCO) to conduct mineral sampling on a 200-acre parcel of property lying within the Jay Mountain Wilderness Area and the Adirondack Forest Preserve, known as lot 8.
