The plaintiff in error hereinafter referred to as the defendant, upon an information filed against him *234in the Criminal Court of Record of Dade County, was tried, convicted and sentenced for the crime of living in an open state of adultery, and, by writ of error, brings this judgment here for review.

The first assignment of Error complains of the denial of the defendant’s motion to quash the information on the ground that it does not charge the offense in the language of the statute.
