McCORD, Judge.
This, is an appeal from a conviction for murder in the second degree with a penalty of seven years.
An indictment was returned in the District Court of Taylor County at the February .term, 1910, charging the appellant with the murder of one S. C. Hackley, and appellant being brought to trial resulted in his conviction, as aforesaid. The evidence develops that the deceased Hackley was running a boarding-house in the town of Abilene; that he was a man some seventy years of age; that his family consisted of his wife and his stepdaughter; that the defendant was his brother-in-law,…
