The defendants were jointly charged and tried by a jury for the crime of murder. They were represented by separate counsel. A verdict of manslaughter was rendered against each. The defendant, Carlos Topete Dueñas, moved for a new trial, which was denied. The co-defendant, Cuevas, has not appealed. Prom the judgment and order denying a new trial this appeal was perfected by the defendant Carlos Topete Dueñas.
