TRASK, Circuit Judge:
This is an appeal from an order of The United States District Court for the Northern District of California which granted a preliminary injunction to the *474plaintiff, Washington Capitols Basketball Club, Inc., (1) enjoining the defendant, Richard F. (Rick) Barry III from playing basketball for any professional team other than the Washington “Caps” and (2) enjoining the San Francisco Warriors and Lemat Corporation1 from attempting to enforce a five year playing contract signed on August 26, 1969 between Rick Barry and the Warriors.
