Since 1992, the United States Department of Justice’s Antitrust Division has been investigating a wide-ranging price fixing conspiracy among participants in the commercial explosives and ammonium nitrate industries. The appellants, who are plaintiffs in a civil suit related to this conspiracy, filed a Freedom of Information Act request with the Antitrust Division to disclose certain documents related to its investigation.
