Sarinsky’s Garage Inc. (“Plaintiff’) commenced this action against Erie Insurance Company and Erie Insurance Company of New York (collectively, “Defendants”) for breach of contract on a commercial property liability insurance policy, seeking $104,198.44 and a declaratory judgment. Plaintiff commenced a state court action on April 28, 2008, and Defendants subsequently removed the action to this Court on the grounds of diversity jurisdiction, pursuant to 28 U.S.C. § 1332.
