This is an application for writ of habeas corpus, by which appellant seeks to gain his release from the state penitentiary.

A certified copy of the judgment accompanying the record shows that appellant was convicted by a jury in the district court of Jim Wells County, on the 6th day of March, 1941, on an indictment charging that he knowingly and fraudulently passed as true a forged instrument in writing. It is also recited that the indictment alleged two prior convictions for felonies less than capital. The jury returned into court the following verdict, which is copied in the judgment: “We…
