This is an appeal from a decree of distribution of the Hudson County Orphans Court.

On September 10th, 1928, the decedent, Anthony Gutkowski, an infant, was a passenger on a ferry crossing a portion of the navigable waters of the Hudson River lying within a tidewater basin in Jersey City known locally as "The Gap." The ferry is a small boat propelled by a single oar and serves persons journeying from the downtown section of Jersey City to the railroad yards of the Lehigh Valley Railroad.
