ORDER 1

BARTLETT, District Judge.

Based on a citizen’s complaint and subsequent investigation, the Chief of Police of the Kansas City, Missouri, Police Department (the KCPD) assessed a three-day disciplinary suspension against plaintiff for the use of unnecessary force in the performance of his duties. Plaintiff asserts a claim under 42 U.S.C. § 1983 for deprivation of procedural due process guaranteed by the Fourteenth Amendment and asks the Court to declare the KCPD disciplinary procedures unconstitutional. 2 Defendants have filed a motion for summary judgment asserting that plaintiff does…
