MEMORANDUM AND ORDER

This is a Motion to Dismiss the Indictment based on Rule 6(f) of the Federal Rules of Criminal Procedure and the Fifth Amendment. Defendants allege that the indictment procedure was defective in this case because the Grand Jury foreman did not read the indictment before signing it under the traditional certification “A True Bill.” This allegation was raised in open court on April 28, 1969, at what was originally scheduled to be a “Gaither hearing.” 1 But, subsequent to the scheduling of said hearing, the Court of Appeals issued its…
