This appeal is from a judgment in favor of plaintiffs in an action to recover damages for personal injuries.

*343The bus involved in the accident was used by the defendant on a bus line it operated over certain streets, in the borough of the Bronx, designated in the franchise granted to it "by the city of New York. Rochambeau Avenue on which the accident occurred was not one of the designated streets.
