On May 22, 1916, the plaintiff in error, Frank Halbert, hereinafter called defendant, was informed against in the district court of Canadian county for an attempt made on May 12, 1916, to ravish Flora Griffin, a female under the age of 14 years. This information was later amended, and upon trial, November 29, 1918, the defendant was convicted of an assault to commit rape in the second degree, and was sentenced to imprisonment for a term of 4 years in the state penitentiary. To reverse this judgment the defendant prosecuted this appeal.
