The defense relied on by appellee in the trial court is, that appellants’ membership in the association became absolutely forfeited by the non-payment of the first note mentioned in the foregoing statement. Appellants’ counsel contend, on the contrary, that there was no forfeiture, for support of which position they urge the following reasons : First, that no power to declare a forfeiture is reserved in the certificate of membership; second, that it does not appear from the stipulation of facts, or otherwise, that the articles of association of appellee included in the stipulation of facts…
