DAVIDSON, Presiding Judge.
Appellant was convicted of an assault to rape, the punishment assessed being t-wo years in the penitentiary. He requested the court to charge the jury, in substance, that if it has been shown by a preponderance of the evidence that the defendant was insane at any time before the commission of the crime, charged in the indictment, then such insanity is presumed to continue, and the burden of proof is upon the State to show that the defendant afterwards became sane, and while in that condition committed the crime charged in the indictment.
