The Williams’ (appellees) entered into a contract with Peerless Construction Company and/or Reynolds Engineering & Supply Company 1 on October 21, 1958. Peerless agreed to make certain improvements on the Williams’ home and to pay the balance then owing on their automobile. The Williams’ promised to pay $3200 in monthly installments. Subsequent to the execution of the contract, the Williams’ executed a promissory note in the amount of $6399.60 and a mortgage of their residence property to Reynolds Engineering securing payment of this amount.
