On or about January 22, 1929, James R. Dousay, the plaintiff, was injured while in the employ of the" defendant, Hillyer-Edwards-Fuller, Inc., at Glenmora, in Rapides parish. Plaintiff was engaged with his colaborer in sawing down trees and converting them into logs for sawmill purposes. While he was thus engaged on the day named, suddenly a large heavy limb from the tree they were sawing broke and fell a distance of over fifty feet, and, as it was falling, struck the plaintiff on his body about the neck, right shoulder, and back, and knocked him to the ground.
