This is an appeal from the order of the district court discharging a writ of habeas corpus and remanding the appellant to the custody of the sheriff of Nicollet county. By stipulation the case was heard here on the record made in the district court.

The appellant was formerly a resident of Iowa and has been indicted in that state for deserting his Avife. The Iowa authorities applied to the governor of this state for extradition of the appellant.
