ORDER
HAWKINS, District Judge.
This is a case of admiralty and maritime jurisdiction within the meaning of Rule 9(h) of the Federal Rules of Civil Procedure. On the afternoon of Sunday, May 8, 1977, June Catherine Sweeney was a passenger in a fourteen and one-half foot outboard motor boat owned and operated by her husband, Roy W. Sweeney. At a point on the Atlantic Intracoastal Waterway between Mt.
