MAXWELL, Chief Judge.

Petitioner, Vance Raleigh, is presently incarcerated in the West Virginia State Penitentiary for an indeterminate term of not less than one nor more than fifteen years. The sentence was imposed by the Circuit Court of Fayette County, West Virginia, following Petitioner’s entry of a guilty plea to the charge of burglary. The sentence was suspended and Petitioner was placed on probation for a period of three years by the state court on January 13, 1966.
