MEMORANDUM OPINION AND ORDER

Plaintiff Marcel Yonan (‘Yonan”) is a soccer referee and lawyer. In 2007, defendant United States Soccer Federation, Inc. (“the Federation”) told Yonan, then 50 years old, that he would not be assigned to work Major League Soccer (“MLS”) games. He sued, alleging age discrimination in violation of the Age Discrimination in Employment Act (“ADEA”) (29 U.S.C. § 621 et seq.) and retaliation.
