A judge of the Superior Court reserved and reported this case to the Appeals Court without decision on August 9, 1976, pursuant to Mass. R. Civ. P. 64, 365 Mass. 831 (1974), and G. L. c. 231, § 111. The report was made at the request of the parties, the parties having agreed in writing as to all the material facts. We transferred the case here on our own motion.
