The plaintiff, Fireman’s Fund Insurance Company, a private corporation, a non-resident of this State, carrying the compensation insurance of defendant’s employer, filed this cause in this court on November 6,1962, against the defendant, Alfred A. Jekel, seeking to set aside the final ruling and decision of the Industrial Accident Board of the State of Texas made on November 5,1962, in a matter pending before said Board styled Alfred A.
