MEMORANDUM AND ORDER

This action involves conflict between Rid-dell Sports Inc. (“Riddell”), a manufacturer of football helmets and other sporting goods, and Frederic H. Brooks, formerly President of Riddell, then a consultant to that company, and still later Chairman of MacGregor Sporting Goods (“MacGregor”). Riddell contends that Mr. Brooks violated his contractual obligations and fiduciary duty by utilizing confidential information in assisting other parties in litigation against Riddell.
