DECISION ON THE MERITS
HANSEN, District Judge.
This case is before the court on plaintiff’s and defendant’s cross-motions for summary judgment. Both sides have filed numerous briefs. The parties have agreed to defendant’s statement of undisputed facts. Plaintiff's supplement to defendant’s statement of undisputed facts is not contradicted by defendant.
