James Eose was convicted of the crime of manufacturing intoxicating liquor with intent to sell, and prosecutes this appeal At the trial in the lower court, he was represented by counsel other than the one now prosecuting this appeal.

There are numerous assignments of error, only three of which are discussed in the briefs, the first of which is that the. court erred in refusing to dismiss the action, because appellant was not brought to trial within sixty days after he was charged and arrested.
