Appeal from an order and judgment of the Supreme Court (Hard, J.), entered August 8, 2007 in Albany County, which, among other things, denied a motion by defen*918dant American Home Assurance Company for summary judgment dismissing the complaint against it and entered a declaration in favor of plaintiff.
