Before the Court are plaintiff Lopez & Medina Corp.’s (hereinafter “L & M” or “Plaintiff’) Cross-Motion for Summary Judgment (Docket Nos. 83-85) and defendant United States Aircraft Insurance Group’s 1 (hereinafter “USAIG” or “Defen dant”) Opposition thereto (Docket No. 88). Plaintiffs motion aims to lay to rest the dispute as to whether an insurance policy issued by Defendant covers the breach of contract claim that Plaintiff originally sued under.
