BACKGROUND

On January 30, 1989, after a jury found him guilty of three counts of sodomy in the first degree,1 James M. DiGioia was conviet-*494ed in Rensselaer County Court. The Appellate Division, Third Department affirmed that conviction, People v. DiGioia, 168 A.D.2d 865, 564 N.Y.S.2d 533 (3d Dep’t 1990), and the Court of Appeals denied leave to appeal. People v.
