Cullen, Ch. J.:

The appellant was convicted at the Warren County Trial Term of murder in the first degree in having killed Rachael Kugle. The murdered woman resided with her husband and two children, a daughter of fifteen years and a son of nine, in a cottage in Glens Falls near the Hudson river. The parties were Polish Hebrews who had resided in this country for a number of years. The occupation of the defendant and that of his sister’s husband was peddling.
