LEAVITT, District Judge.

This is an action of ejectment for a tract of land in Clark county. By agreement of counsel' the case was submitted and argued at the last term, without the intervention of a jury, and with the understanding that the evidence offered was to be received, subject to all legal exceptions to its competency. The lessors of the plaintiffs, as proof of title, have introduced a patent from the United States, dated the 17th of June, 1817, granting the tract in controversy to Joseph Lamb’s heirs; and, in connection with this, they have proved that they are the legal heirs of the…
