Only one question is presented for determination, and that is whether or not this cause should have been submitted to the jury. In order to arrive at a solution for the problem, a careful consideration of the facts is first necessary.

Historically they áre the following: James R.-Shipley, in the year 1922, secured a contract with the Iowa state highway commission and the board of supervisors of Guthrie County to grade á part of the main road between Guthrie Center and .Panora.
