Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent Commissioner of Correctional Services which found petitioner guilty of violating a prison disciplinary rule.

During a mail watch, a correction officer discovered that petitioner had sent a letter to a female in Minnesota directing her to open a large white envelope she had received, to mail a preaddressed stamped envelope contained inside and to notify him when the mailing was complete.
