The Chancellor.

This was an appeal from the decree of the vice chancellor of the first circuit, overruling a demurrer to a part of the complainant’s bill, and overruling a part of the exceptions.taken by the defendant to the master’s report, on exceptions to the answer. The hill was tied the 9th of January; 1830, upon the return of an execution at law, unsatisfied. The judgment at law was recovered upon a deed of covenant entered into by the defendant on the 1st of June, 1827 ; and the judgment in the superior court of the city of New-York was docketed the 15th of December, 1829 ; and an *235execut…
