Appellee, Mitchum, instituted this suit against the appellant to recover damages for personal injuries. As alleged, the injuries were the result of a fall alleged to have been occasioned or proximately caused by the negligence of certain employes of the railway company. The injuries are allege?! to have occurred on or about the 20th day of January, 1907, and the record shows that there has been at least three trials upon which Mitchum recovered a judgment, and the case has been before our appellate tribunals three or more times.
