MEMORANDUM OPINION AND ORDER

EDWARD J. BOYLE, Sr., District Judge:

Billy Ray Layton brings this action against Land & Marine Applicators, Inc. (Defendant) for injuries allegedly received while he was in the employ of Land & Marine Applicators, Inc. as a member of the crew of the vessel M/V MR. RED II. Land & Marine’s workmen’s compensation and employer’s liability insurer, Aetna Casualty & Surety Co., denied coverage for and refused to defend against Layton’s claim. Land & Marine filed a third-party complaint against Aetna for reimbursement and indemnification in the event it should be held…
