This appeal arises out of the district court’s sua sponte dismissal of a qui tam action brought by plaintiffs-appellants S. Prawer & Company, Gilbert Prawer, and Harvey Prawer (collectively “Prawer”) as re-lators under the False Claims Act (“FCA”), 31 U.S.C. § 3729 et seq. 1 Plaintiffs primarily 2 contend that the court erred in concluding that 31 U.S.C. § 3730(e)(3), 3 a provision enacted as part of the 1986 amendments to the qui tam provisions of the FCA, bars their claim.
