WARRINGTON, Circuit Judge.

Final decree was entered below upon an accounting and report of a master. Three suits were originally brought by appellee against appellant upon three distinct patents ; and interlocutory decrees were entered, adjudging that the Clark patent, No. 676,420,. contested in the first suit, was valid, though not infringed, and that the Turner patents, Nos. 930,107 and 930,633, involved, respectively, in the second and third suits, were invalid.
