This case is submitted to me under a stipulation *663upon an agreed statement of the facts. It appears that the plaintiff was the owner of the premises known as 1239 Madison avenue in the borough of Manhattan, city of New York, wherein the defendant occupied an apartment as a tenant; that prior to October 1, 1919, the defendant, the tenant, had secured a lease in writing from the plaintiff’s grantor for the term of one year from October 1,1919, to September 30,1920, at an annual rental of $2,200 payable in equal monthly installments in advance on the first day of each and every month; that on the…
