Appeal by the defendant, The Town of Bath, from' a judgment of the Supreme Court in favor of. the plaintiff, entered in the office of the clerk of the county of Steuben on the l-6th day of June, 1909, upon the verdict of a jury for $2,500, and also from an order entered in said clerk’s office on the same day denying the defendant’s motion for a new trial made upon the minutes.

Reuse, J.:

The action is to recover damages for personal injuries resulting from the faulty construction of a highway bridge as the plaintiff contends and as the jury found.

The plaintiff was hurt in this way: He was leading a blindfolded cow along the highway. When about the middle of the bridge in *332question the cow attempted to turn around and go back or get off the bridge at the side.
