Affirming.

The appellant, P. L. Terry, was the administrator *de bonis non with the will annexed of the estate of J. B. Farris, deceased. On the 28th day of November, 1936, appellant and Dan Cnrd entered into the following (contract or writing signed by “P. L. Terry, Admr.”:

“Know All Men by These Presents that P. L. Terry, Administrator of the estate of J. B. Farris, deceased, for and in consideration of the snm of $-- payable ($50.00) Dollars cash, and the balance thereof upon delivery of a deed for the property hereinafter described, does hereby…
