Defendant, Kenneth R. Smith, was charged by indictment with three counts of first-degree murder (720 ILCS 5/9 — 1(a)(1), (a)(2), (a)(3) (West 1994)) and one count each of armed violence (720 ILCS 5/33A — 2 (West 1994)), unlawful possession of a weapon by a felon (720 ILCS 5/24 — 1.1(a) (West 1994)), and armed robbery (720 ILCS 5/18 — 2(a) (West 1994)).
