MEMORANDUM OPINION AND ORDER
ARRAJ, District Judge.
This is a diversity action brought by Telectronics, Inc. (“Telectronics”) against one of its insurers, United National Insurance Company (“United”), alleging breach of contract and bad faith breach of an insurance contract. The plaintiff has moved for summary judgment pursuant to Fed. R.Civ.P. 56. The defendant filed a cross motion for summary judgment and has moved for sanctions on the basis that the plaintiff’s second claim for relief is groundless or without substantial justification.
