The plaintiff was improperly nonsuited. His counsel asked to have the case submitted to the jury on the question of the defendant’s negligence, which *263was denied, and an exception duly taken. The action was brought to recovor damages sustained by the plaintiff, occasioned by the wrongful and negligent conduct of the defendant in not keeping the bridge across the canal at Geddes street in Syracuse in repair and in a safe condition.
