In this interlocutory appeal, appellants' the Texas Health and Human Services Commission (HHSC) and Kyle L. Janek, HHSC’s Executive Commissioner, challenge the trial court’s denial of their plea to the jurisdiction; See Tex. Civ. Prac. & Rem.Code § 51.014(a)(8). Appellee F. Michael McMillen, a former employee of HHSC, sued HHSC and Janek in his official capacity alleging violations of the Texas Whistleblower Act and the free speech clause of the Texas Constitution.
