*351Defendant, Pedro Soto, was convicted by a jury on May 25, 1993 of acting in concert with others in committing the crimes of murder in the second degree (Penal Law § 125.25 [1]), three counts of kidnapping in the first degree (Penal Law § 135.25 [2] [a], [c]; [3]), conspiracy in the second degree (Penal Law § 105.15), and criminal impersonation in the first degree (Penal Law § 190.26).
