Court for the Trial of Impeachments and Correction of Errors
On appeal from chancery. The cause was commenced before the assistant vice chancellor of the 1st circuit, where a decree was made in favor of the complainant, which was affirmed by the chancellor on appeal. The facts of the case, with the opinion of the assistant vice chancellor, will be found in 1 Hoffman’s Ch. Rep. 282, and the opinion of the chancellor in 11 Paige, 290. In. 1768, John Bridgewater and wife gave a mortgage on the lot of land in question in this case, to Sheffield Howard, to secure the payment of one hundred pounds at the end of one year from the date of said mortgage. In the spring of 1782, Bridgewater was indebted to Medcef Eden, senior, in the sum of one hundred and sixty-eight pounds, for which amount he then gave him his bond. In the course of that or the next year, Eden, upon some arrangement with Bridgewater, entered into possession of the lot so mortgaged to Howard, and in December, 1783, Howard sold and assigned the mortgage to Eden.…
